Terms of Use

By accessing or using the OwlWho website, application, or services (the "Service"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

OwlWho is an artificial-intelligence study assistant. Responses are generated by large language models and may be inaccurate, incomplete, biased, or out of date. Output is not professional, medical, legal, financial, or academic advice. You are responsible for independently verifying any information produced by the Service before relying on it. Prompts, uploads, and conversations are sent to third-party AI providers to generate responses as described in our Privacy Policy.

• Do not use the Service to generate, share, or submit harmful, hateful, harassing, sexual, or illegal content.
• Do not attempt to bypass security measures, rate limits, or access other users' data.
• Do not reverse engineer, scrape, or use the Service to train competing AI models.
• Respect the academic-integrity policies of your school or institution. You are solely responsible for how you use AI-generated content in academic settings.

Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe. Monthly is the only billing period currently offered; if other billing periods are added later, they will be shown on the Pricing page before you subscribe. You authorize us to charge your payment method for each billing cycle until you cancel. You may cancel at any time from Settings; cancellation takes effect at the end of the current billing period, and you retain access until then.

Refunds: Subscription fees are generally non-refundable except where required by law. If you believe you were charged in error, contact aj@owlwho.net within 14 days and we will review your request in good faith.

The Service is provided strictly as a productivity and study aid. Use of the Service does not guarantee perfect grades, academic success, or specific testing outcomes. You assume all risk and responsibility for your own work, answers, and grades achieved while using the Service. OwlWho is not liable for any academic, disciplinary, or school-related penalties resulting from your use of AI-generated output.

You may delete your account at any time from Settings → Delete Account. We may suspend or terminate accounts that violate these Terms, abuse the Service, threaten platform integrity, or are required to be terminated by law. Upon termination your access ends immediately; data deletion follows our Privacy Policy.

OwlWho is intended for users age 13 and older. We do not knowingly collect personal information from children under 13. We do not operate a parental- or school-consent process, so accounts we identify as belonging to users under 13 will be terminated. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED OUTPUT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWLWHO LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GRADES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID OWLWHO IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

Please read carefully — this section affects your legal rights. You and OwlWho agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that (i) either party may bring an individual claim in small-claims court, and (ii) either party may seek injunctive relief in court to protect intellectual property rights.

The arbitration will take place in the United States, and judgment on the award may be entered in any court of competent jurisdiction. You and OwlWho waive any right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. If any part of this section is found unenforceable, the remainder will remain in effect.

30-Day Right to Opt Out: You may opt out of this arbitration agreement by emailing aj@owlwho.net within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out" and including your account email. This section applies only to the extent permitted by applicable law.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws rules. We may update these Terms from time to time; material changes will be announced in-app or by email, and continued use of the Service after the effective date constitutes acceptance.
